Austin, Texas Text Message Ban

In 2009, Austin amended their city code to prohibit electronic messaging while driving. The new ordinance states, "A driver of a motor vehicle may not use a wireless communication device to view, send, or compose electronic messages or engage other application software while operating a motor vehicle." It does not prohibit talking or dialing a cell phone or engaging in the prohibited behavior while a vehicle is stopped, emergency situations, or affect GPS interaction.

The Texas Governor signed House Bill 55 in June of 2009. This Bill prohibits the use of a wireless communication device within any school zone in Texas. There is an exception for the use of a hands-free device. This law also prohibits bus operators from using a wireless communication device while operating a passenger bus with a minor passenger unless the bus is stopped or there is an emergency situation.

The Texas Department of Public Safety has championed new laws regarding cell phones and other wireless communication devices for drivers that are under the age of 18. All drivers under the age of 18 are restricted from using a wireless communication device while operating a motor vehicle. This restriction applies to licenses issued after September 1, 2009, to applicants who are under 18. All drivers under 18 who were issued an original driver's license before September 1, 2009, are still restricted from using a wireless communication device during the six-month period following the issuance of that original license.
